"Carpets & More at Warsaw Home"

  1. GENERAL

The organizer of the Carpet & More at Warsaw Home competition (hereinafter referred to as the "Competition") is
CARPETS AND MORE Magdalena Świerlikowska
Ul. Wiertnicza 169, 02-952, Warsaw, NIP: 532 138 43 66

The Partner of the Competition is OKK Olga Kisiel-Konopka, ul. Wyspowa 2/32, 03-687 Warsaw, NIP: 545-165-53-55, which supports the Organizer in conducting the Competition.

  1. The Competition is not a game of chance within the meaning of Art. 2 section 1 of the Gambling Act of 19.11.2009 November 2018 (Journal of Laws of 165, item XNUMX) and is not subject to the regulations contained in the aforementioned Act and implementing regulations to this Act.
  2. Entries to the competition can be submitted from 23.10.2024/10.11.2024/XNUMX to XNUMX/XNUMX/XNUMX in the manner specified in the Rules.
  3. The Organizer is the person providing the prize within the meaning of Articles 919 and 921 of the Civil Code.
  4. The Organizer declares that the Contest is in no way sponsored, endorsed, conducted, administered or associated with Facebook or any entity that owns Facebook. Facebook's liability in connection with the Contest is generally excluded.
  5. Media patronage over the Elle Decoration competition
  6. COMPETITION PARTICIPANTS
  7. A participant of the Competition (hereinafter referred to as the "Participant") may be an adult natural person with full legal capacity, residing in the territory of the Republic of Poland, who will complete a competition task during the Competition.
  8. Employees and representatives of the Organizer and other entities directly involved in the preparation and conduct of the Competition on behalf of the Organizer, their spouses, descendants, ancestors and siblings cannot participate in the Competition.

III. COMPETITION RULES

  1. By taking part in the Contest, the Participant accepts the provisions of these Regulations. The Contest is conducted on Facebook and Instagram. Entries sent in any other way will not be considered.
  2. The competition task is to:
    1. Creating a photo from the Carpet & more stand at Warsaw Home&Contact 2024 and publishing it on your social media (Instagram or Facebook)
    2. Contest participants, in accordance with the principles set out in the Regulations, are required to post the contest project on their social media and mark it with the hashtag:
      #mojeclassics #MagdaFornalDesign and tag @carpetsandmore_pl on Instagram
  3. Contest works published after 28.10.2024/XNUMX/XNUMX will not be included in the Contest.
  4. The condition of participation in the Contest is also to maintain works on social media until 28.11.2024. If the Participant deletes the contest task before this date, he or she will not be able to receive the prize. For the duration of the Contest, the Participant's social media profile should be public. Contest works published on "private" accounts, i.e. with limited access, will not be taken into account.
  5. All competition entries will be assessed by the Competition Jury appointed by the Organizer, which includes:

    Katarzyna Borejko – Marketing Manager Carpets & More
    Olga Kisiel-Konopka – Managing Director of OKKPR
  6. The committee will take into account:
    1. creativity of the competition work
    2. the connection of the competition work with the topic
    3. quality and level of photo presentation
  7. Competition works:
  8. should be in the form of a photo,
  9. should be the result of the Participant's personal creativity,
  10. may not infringe the rights of third parties, in particular personal rights and copyrights of third parties, trademark rights or any other exclusive rights.
  11. The Organizer reserves the right to exclude from the Contest any person whose contest entries violate the requirements specified in the Rules. The contest entries of such persons will not be included in the Contest at all.
  12. By submitting a competition entry, the Participant declares that he/she has unlimited copyright to the photo submitted as part of the Competition. The Organizer is not responsible for any infringement of copyright or other rights or property of other persons by the Participants of the Competition. In the event that authorized persons contact the Organizer with claims in connection with the use by him/her of the competition entries submitted as part of the Competition and awarded, the Participant who posted the contest entry in question is obliged to indemnify the Organizer from third party claims or compensate the Organizer for any damages resulting from the need to satisfy third party claims.
  13. The Competition Committee will evaluate the competition entries on October 31.10.2024, XNUMX.
  14. The Competition Committee, based on the criteria specified in the Regulations, will select the authors of the best competition works.
  15. Information about the winners will be published on social media within 7 days after the deliberations of the Competition Committee.

  16. Too few competition entries or no competition entries that meet the provisions of these regulations and thus the inability to select winners entitle the Organizer not to adjudicate the competition.
  17. The winner is not entitled to exchange the prize for another prize or for cash.

IV. AWARDS

  1. The following prizes will be awarded in the Competition final:
    Each winner receives a one-year subscription to Elle Decoration

    1. First place: Voucher for the purchase of a carpet worth PLN 3
    2. Second place: A voucher for a carpet worth 2
    3. Third place: A voucher for a carpet worth 1
  2. The prizes will be handed over in the form of a personal collection of the voucher at the Carpers and More Showroom at ul. Wiertnicza 169 in Warsaw within 30 days of the end of the competition (i.e. 30.11.2024)
  3. Prizes will be awarded to winners who meet the conditions of these Regulations.

V. COMPLAINT PROCEDURE

  1. Any questions or complaints regarding the Contest should be sent by e-mail to: biuro@okkpr.pl Complaints are accepted no later than (the date of receipt of the message on the Organizer's incoming mail server is decisive). Failure to meet the above deadline does not prevent Participants from pursuing appropriate claims in court or out-of-court proceedings.
  2. The complaint should contain data enabling the identification of the Participant and an indication of the reasons and grounds for submitting it.
  3. Complaints will be reviewed within 2 business days of receipt. The response will be sent to the email address from which the report was sent.
  4. The Organizer is not responsible for the failure of the Participant to receive emails sent to them in connection with the Contest, resulting from the Participant providing incorrect personal data or from the Participant using anti-spam tools and settings. In the event of using anti-spam tools and settings, the Participant is obliged to regularly check whether messages from the Organizer have not reached the email box containing messages classified as spam.

VI. PERSONAL DATA

  1. The administrator of the personal data of the Participants is Carpets & More, Magdalena Świetlikowska, ul. Wiertnicza 169, 02-952 Warsaw. Carpets & More processes the personal data of the Participants in connection with the Participants' entry into the Contest (Article 6 paragraph 1 letter f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC; hereinafter referred to as "GDPR").
  2. Carpets & More processes the personal data of Participants for the legal purpose of processing personal data for marketing purposes is the legitimate interest of the administrator (Article 6 paragraph 1 letter f of the GDPR), in order to:
    1. the purpose of organizing and conducting the Competition,
    2. communication with Participants;
    3. issue of Awards;
    4. handling complaints;
  3. The Organizer may use the personal data of Participants for marketing purposes consisting in promoting goods and services as well as products and services of the Organizer's business partners. The legal basis for the processing of personal data for marketing purposes is the legitimate interest of the administrator (Article 6, paragraph 1, letter f of the GDPR), consisting in conducting marketing activities.
  4. In cases other than those indicated above, the personal data of Participants will be processed only on the basis of previously granted consent, to the extent and for the purpose specified in the content of the consent.Obligation to provide personal data
  5. Failure by the Participant to provide all required personal data may constitute an obstacle to the Participant's participation in the Contest and provision of the Contest.
  6. To the extent that personal data are collected on the basis of consent, the provision of personal data is voluntary.
  7. The processing of personal data will include the scope of data indicated in the Competition entry form, as well as other data provided by the Participant in connection with participation in the Competition.Information about recipients of personal data
  8. In connection with the processing of Participants’ personal data for the purposes indicated in point 1 above, Participants’ personal data may be made available to the following recipients or categories of recipients:
  9. entities participating in the processes necessary to carry out the Contest; in order to manage the Contest, the personal data of the Participants were entrusted to the OKK!PR agency for processingPeriods of personal data processing
  10. The personal data of Participants will be processed for the period necessary to process the Participant’s participation in the Competition.Data subject rights
  11. Carpets & More ensures that all persons whose personal data is processed have appropriate rights under the GDPR, i.e.:
    1. the right to access personal data, including the right to obtain a copy of such data;
    2. the right to request rectification (correction) of personal data – if the data is incorrect or incomplete;
    3. the right to request the deletion of personal data (the so-called "right to be forgotten") - where (i) the data are no longer necessary for the purposes for which they were collected, (ii) the data subject has objected to the processing of personal data, (iii) the data subject has withdrawn the consent on which the processing is based and there is no other legal basis for the processing, (iv) the data are processed unlawfully, (v) the data must be deleted in order to fulfill an obligation arising from the law;
    4. the right to request the restriction of the processing of personal data – (i) the data subject questions the accuracy of the personal data, (ii) the processing of the data is unlawful and the data subject opposes the deletion of the data, requesting their restriction instead, (iii) the controller no longer needs the data for their purposes, but the data subject needs them to establish, defend or pursue claims, (iv) the data subject has objected to the processing of the data – until it is determined whether the legitimate grounds on the part of the controller override the grounds for the objection;
    5. the right to transfer personal data where: (i) processing is carried out on the basis of a contract concluded with the data subject or on the basis of the consent expressed by such person, and (ii) processing is carried out by automated means;
    6. the right to object to the processing of personal data, including profiling, when (i) there are reasons related to the specific situation of the Participant, and (ii) the processing of data is based on the necessity for the purposes of the legitimate interest of Cosentino.

    The right to withdraw consent to the processing of personal data

    To the extent that the Participant has given consent to the processing of personal data, he or she has the right to withdraw consent to the processing of personal data at any time. Withdrawal of consent does not affect the lawfulness of data processing carried out on the basis of consent before its withdrawal. The Participant is entitled to submit a request by writing an e-mail to magdas@carpetsandmore.pl

    The right to lodge a complaint with the supervisory authority

    If it is found that the processing of the Participant's personal data violates the provisions of the GDPR, the Participant has the right to lodge a complaint with the supervisory authority, i.e. the President of the Personal Data Protection Office.

VII. COPYRIGHT

  1. The Organizer reserves the right to use the materials submitted by the Participants as competition entries for the Organizer's promotional purposes. For this purpose, the Participants, in exchange for the opportunity to participate in the Competition, grant the Organizer, without additional remuneration, a non-exclusive, unlimited in time and territory, license to use the works submitted to the Competition in the following fields of exploitation:
    1. producing copies of the work by any technique, including printing, reprographic, magnetic recording and digital techniques;
    2. reproducing the work in any other way that does not result in the production of copies, in particular introducing the work into computer memory;
    3. distributing copies of the work, in particular by placing them on the market, lending or renting the original or copies;
    4. distributing the work without the intermediation of copies, in particular public performance, exhibition, display, reproduction and broadcasting and re-broadcasting, as well as making the work available to the public in such a way that everyone can have access to it at a place and time of their choosing;
    5. use in any way, regardless of the medium used, in whole or in part, in advertising and marketing activities.
    6. Upon the issue of the Prize, the Organizer acquires, without separate remuneration (i.e. as part of the Prize received), all copyrights to the work in the form of the awarded competition work, without any time or territorial restrictions (i.e. worldwide), in particular in the scope of the following fields of exploitation:
    7. producing copies of the work by any technique, including printing, reprographic, magnetic recording and digital techniques;
    8. reproducing the work in any other way that does not result in the production of copies, in particular introducing the work into computer memory;
    9. distributing copies of the work, in particular by placing them on the market, lending or renting the original or copies;
    10. distributing the work without the intermediation of copies, in particular public performance, exhibition, display, reproduction and broadcasting and re-broadcasting, as well as making the work available to the public in such a way that everyone can have access to it at a place and time of their choosing;
    11. use in any way, regardless of the medium used, in whole or in part, in the advertising and marketing activities of the Organizer.
  2. Upon the issuance of the prize, the Participant transfers to the Organizer the copyright property rights to the work in the above-mentioned scope, together with the exclusive right to exercise dependent copyrights and the exclusive right to authorize the exercise of dependent copyrights to the work, and also authorizes the Organizer to decide on the first release of the work to the public, as well as to exercise other personal copyrights to the work, and the Participant undertakes not to exercise personal copyrights to the work. The Organizer is not obliged to distribute the work.
  3. At the same time, the winners of the Competition grant their consent to the use and dissemination of their image by the Organizer for the purpose of presenting the awarded works in information and marketing materials related to the Competition and its future editions, as well as in the Organizer's promotional activities (in particular on the Internet, in press releases, on the Cosentino.com website, in social media and in subsequent editions of the Competition).

VIII. FINAL PROVISIONS

  1. The regulations are available on the website cosentino.com and at the Organizer's registered office. The Organizer reserves the right to change these regulations to the extent permitted by law. The rules for conducting the Contest are specified exclusively in these Regulations. The Participant may obtain, reproduce and save the text of the Regulations by downloading it independently from the above sources.
  2. The Organizer is solely responsible for conducting the competition (Facebook is released from liability). This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.
  3. The Organizer is not responsible for any change of place of residence or change of correspondence address provided by the Participant, as well as for any changes in other data that prevent the Participant from being properly notified or receiving the prize. Participants whose personal data have changed after being notified to the Organizer are required to immediately notify about the aforementioned change and provide new personal data if the change in personal data prevents the delivery of correspondence.
